Once the owners have confirmed the booking to you and you have paid a deposit, the named person on the booking form will be responsible for the total rental price of the property, as agreed. The remaining balance of the agreed rental cost must be paid eight weeks prior to your arrival. If the full balance of the rental cost is not paid as in accordance with these booking conditions, we reserve the right to cancel your booking and cancellation penalties will apply.
Security Deposit /Bond
A bond of £150 sterling or $250 US will be held against loss or damage occassioned by the use of the property by the parties to this agreement. This bond is to be paid eight weeks before arrival along with the final balance. The bond will be fully refunded after a satisfactory status report has been received from the management company, no later than four weeks from your departure from the villa. In the event of any excess damage of any kind, excessive cleaning costs by our agents the named person on the booking form will be held responsible for all additional costs which exceed the security deposit.
Breakages
All breakages, accidents or losses must be reported to the management company as soon as possible. The client agrees to pay the full cost of any breakages, losses or damages to the property
Keys
When you arrive at the house, the keys to enter are located in a key safe on the left hand wall of the porch. Enter the combination and slide the latch at the top down, this will release the door of the small safe and you can remove the keys. To replace the safe door, enter the code again, slide the latch down and replace the door in the safe mounting.
When departing the villa, you must exit via the front door, locking it securely, then the keys MUST be replaced in the lock box.
Failure to comply with this will result in callout charges totaling approx $200.
Lost keys must be reported to the management company immediately and additional charges will be incurred
Payment
For UK guests payment can be made by sterling cheques mailed to the owner's UK address.
US guests can make payment into our America Wachovia bank account.
In addition, secure payment in sterling, US dollars or euros can be made online via the PayPal website using any major credit or debit card.
Cancellations
Providing the owners receive written notice of cancellation not less than 8 weeks prior to the actual booking date, the signatory will not be liable to pay the full balance. It is the responsibility of the signatory to ensure that a signed cancellation letter reaches the owner. E-mail cancellations are acceptable but confirmation of cancellation must be confirmed in writing. The reservation deposit will be forfeited. If cancellation is received after 8 weeks, the following terms will apply(a) Between 4 and 8 weeks before arrival - 50% of total rental. (b) Less than 4 weeks before arrival - 100% total rental. The owners reserve the right to cancel any bookings providing written notice is given and any balance paid refunded. In the unlikely event that circumstances beyond our control necessitate cancellation of the booking, we will refund any monies paid to the party leader. (Without interest, compensation or consequential loss of any kind).
Responsibilities
All persons stated on the booking form are responsible for the care of the property and are expected to take reasonable care of it including the locking of all doors, topping up the pool water is done by the management company although guests may fill up if so required. At the end of the rental period, all utensils, carpets, furnishings, walls, fittings, must be left clean and tidy. It is the guests responsibility to notify the management company immediately of any sudden equipment failure so that reasonable action can be take to rectify the situation.
Party Size
Number of adults and children must be listed on the booking form, including small children. The accommodations cannot be shared or sub-let and only the persons shown on the booking form are permitted to stay in the property. No pets are permitted. Persons under 21 years of age are not acceptable unless accompanied by parents or responsible adults. The property is fully licensed for short-term rentals in Florida. The owners reserve the right to refuse admittance if this condition is not met. Failure to comply will render the booking void and no compensation will be paid.
Smoking/Pets
For the safety and comfort of all our guests smoking is not permitted within the property. Smoking is permitted outside the property. No pets are allowed.
Liability
The owners and the management company of the property accept no responsibility whatsoever for death, personal injury, accidents, loss or damage to persons or personal belongings however caused. The use of all accommodations and amenities including the pool is entirely at the user’s own risk. The owners or management company cannot accept any liability for any loss of rental time due to travel problems, flight delays or cancellations, industrial disputes or any events outside our control, including any form of Force Majeure. The owners and the management company cannot accept responsibility for the sudden failure of villa equipment but will take immediate reasonable action to rectify any such failure upon notification by the guests.
Force Majeure
As with any other holiday, there maybe circumstances completely beyond our control and contemplation, in which the property might not be available for your booking. Examples of these circumstances include (but are not limited to) destruction of or severe damage to the property,Strikes, Riots, Political Unrest, Hostilities, War or threat of War, Terrorist Activity, Industrial Disputes, Fire, Flood, Technical Problems to Transport, Aircraft Grounding, Closure of Airports or Ports, Weather, or any other event beyond the owners control. Such circumstances are referred to Force Majeure. In the event of Force Majeure, the owners shall not be responsible for any costs connected with any such cancellation, loss or delay howsoever arising.
Swimming Pool
The house has a swimming pool and the owners and the owners agents do NOT accept liability for injury or death, howsoever caused, as a result of use of the pool. Guests are specifically requested to supervise children at all times as the pool is around six feet deep at the deepest part. Guests must also exercise great care on wet surfaces and must not dive into the pool.If the pool heater cannot reach optimum temperature due to adverse cold weather conditions the owners or the management company cannot accept liability.
Air Conditioning
In a sub-tropical climate it is vital that doors and windows are kept closed at all times to keep out the heat and humidity. Failure to do this will result in excessive air conditioning electricity charges, which will be deducted from your security deposit.
The air conditioning controls have been preset and locked at a comfortable level. Guests are not permitted to adjust the air conditioning controls. In Florida's humid climate it is all too easy to freeze up the air conditioning condenser units causing the system to fail. A frozen condenser unit will require the attention of a service engineer and the repair cost will be deducted from the security deposit.
Arrivals and departures
The house will be available for occupancy from 4 pm on the date of arrival and must be vacated by 11:00 am (prompt) on the day of departure.
Insurance
It is a condition of the booking that all members of the Party are covered by travel insurance which carries adequate protection against delays and cancellations, and has adequate medical insurance for the USA, and for your luggage and personal belongings.
Owners Access
The owners or their management company shall be allowed access at any reasonable time during your stay.
Law
This contract is subject to and shall be construed in accordance with the laws of England and all parties hereby submit to the exclusive jurisdiction of the English Courts.
Code of Conduct
The Retreat at LegacyPark is a residential community. The actions of all members of your party should not interfere with the enjoyment of either other holidaymakers or the residents of The Retreat. Please do not use the swimming pool, play loud music or engage in any activity which may cause inconvenience to your neighbours after 10.30pm or before 07.30am. In the event that any member of your party behaves in a way that is likely to cause distress, danger or annoyance to any other holidaymakers, residents ofThe Retreat, the owners or there management company reserve the right to terminate your rental agreement immediately and forthwith. The owners or their management company will not be liable for any costs you will incur, nor shall we pay any compensation, nor make any refunds due to this action.
Complaints Procedure
If, in the unlikely event, you consider you have any cause for complaint whilst in the villa, this must be notified to our local representative as soon as possible.
